Klopfer Update

Facility license granted under the authority of the Indiana State Department of Health (ISDH):

  • Klopfer did not apply for a renewed license for his Gary or Fort Wayne facility when his facility license expired 6/30/2015.
  • The ISDH revoked Klopfer’s facility license in South Bend and Fort Wayne offices prior to the 6/30/2015 expiration and denied reissuing a facility license for Klopfer in SB for July 1, 2015 – June 30, 2016.
  • Klopfer appealed both the revocation and the denial. Under Indiana law, he could continue to perform abortions during the appeal process.
  • A hearing date was set for review of the ISDH decision but Klopfer withdrew his appeal prior to the hearing date. Klopfer was ordered to quit performing abortions in South Bend on November 6, 2015
  • Klopfer does not have a facility license to operate an abortion clinic in the state of Indiana.
  • Klopfer was required to wait 90 days to reapply for a facility license in SB. That date has passed and we continue to monitor any applications for new abortion facilities.

Comment:The ISDH did NOT dismiss any actions against Klopfer’s abortion facility licensing procedures. Klopfer voluntarily dismissed his appeal of the license revocation and renewal denial issued by ISDH. While Klopfer can submit a new application for an abortion facility any place in Indiana at any time, we routinely monitor all applications and none have been filed. Given the history of abortion facilities operated by abortionist Klopfer, it is highly doubtful that a new license would be issued.

License to practice medicine in the state of Indiana granted by the Indiana Medical Licensing Board under the authority of the Indiana Attorney General:

  • Nearly 2,000 complaints filed with Consumer Complaint division of the Indiana office of Attorney General prompted an investigation into Klopfer’s medical license by the Indiana Attorney General.
  • The Attorney General filed administrative licensing  complaints with the Indiana medial Licensing Board to consider appropriate disciplinary action against Klopfer’s medical license in September, 2014 (attached).
  • A hearing was set for March 24, 2016 but was cancelled due to a pre-hearing conference call with the attorneys involved on both sides on March 15, 2016.
  • As reported in the AG’s pre-hearing order based on the March 15, 2016 conference call (attached), it is anticipated that the respondent (Klopfer) will file for summary judgement.
  • A hearing is set for July 28, 2016.
  • A final hearing, if needed, is set for August 26, 2016.

Comment: No action/inaction taken by the Indiana Attorney General in any way suggests the authorities are backing off their complaint to the Indiana Medical Licensing Board. We have every reason to believe that those in a position to enforce the law regarding abortionist Klopfer will hold him to the same standard of medical care required of all doctors licensed to practice medicine in the state of Indiana.
